Introduction

This Agreement applies to and between you, the user of our services (“you”, “Client”), and Funded Algo Path (“we”, “us”, “our”).

Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of our website or engagement of our services. If you do not agree to be bound by these Terms, you must cease use of our website and services immediately.

These Terms govern your access to and use of our services, including any challenge execution or account management services we provide.

Definitions & Interpretation

In this Agreement:

• “Client” refers to customers, prospective customers, and users of our website and services.

• “Service” refers to challenge execution and funded account management services.

• “Prop Firm” refers to third-party proprietary trading firms unaffiliated with us.

• “Parties” refers collectively to you and Funded Algo Path.

Words importing the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.

Nature of the Service

Funded Algo Path provides prop firm challenge execution and funded account management services.

We are not a proprietary trading firm, broker, financial adviser, or investment manager, and we do not provide regulated financial advice under the Financial Services and Markets Act 2000.

All Prop Firm accounts are opened and maintained directly by the Client with the chosen Prop Firm. We do not hold or control client funds.

Age Restriction

Our services are available only to individuals aged 18 years or older. By using our services, you confirm that you are legally able to enter into a binding contract under the laws of your jurisdiction.

Relationship with Prop Firms

• We are not affiliated with any Prop Firm.

• We have no control over Prop Firm rules, platforms, payouts, or decisions.

• Challenge fees are paid directly by the Client to the Prop Firm.

• We are not responsible for account suspensions, rule changes, or platform outages.

No Guarantee of Results

Trading involves risk. Passing a Prop Firm challenge is not guaranteed.

Any reference to prior outcomes, performance, or success rates is illustrative only and does not constitute a guarantee of future results.

You accept that losses may occur and that challenges may fail.

Refund Policy (Challenge Phase)

Where expressly agreed during onboarding:

• If we fail the challenge phase, we will refund the challenge fee paid by the Client, provided:

  • the Client has complied with Prop Firm rules;

  • the Client has not interfered with the account; and

  • these Terms have not been breached.

Refunds do not apply where failure results from:

• Client interference;

• Prop Firm rule breaches;

• third-party platform actions;

• force majeure events.

Refunds are strictly limited to the challenge fee only.

Fees & Profit Share

No fees are payable to Funded Algo Path unless and until the Client receives a payout from a funded account.

Upon receipt of a payout, we are entitled to a pre-agreed percentage of the payout, as confirmed in writing during onboarding.

Client Responsibilities

You agree to:

• provide accurate information;

• comply with all Prop Firm rules;

• not access or interfere with accounts without permission;

• keep credentials confidential;

• notify us of relevant Prop Firm communications.

Failure to comply may result in termination and loss of refund eligibility.

Risk Disclosure

Trading financial instruments carries significant risk and may not be suitable for all individuals.

You confirm that you understand these risks and accept full responsibility for your participation.

Limitation of Liability

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded under UK law.

Subject to this, we shall not be liable for indirect or consequential losses. Our total liability shall not exceed fees paid to us.

Intellectual Property

All content, systems, documentation, and materials remain the intellectual property of Funded Algo Path and may not be reproduced without written consent.

Termination

We reserve the right to terminate services where:

• these Terms are breached;

• fraudulent or unlawful activity is suspected;

• continuation poses legal or operational risk.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

Third-Party Rights

Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and Fund Algo Path
